Last Monday I won an auction for a Nintendo Wii, I wouldn't normally go for things that expensive on Ebay, but we are all desperate for one and managed to get one for £200 which, although £20 more than the shops, still not too bad and not some stupid price which some are going for.
Anyway, I am still waiting for delivery. I've been in contact with the seller through email a number of times, first excuse was that he was working till 8pm on shift so couldn't get to the Post Office (OK fair enough), then on Saturday, still hadn't sent it, but would definitely get it sent on Monday (yesterday) and email me with the tracking number for special delivery (which I paid an extra £10 so we could get the darn thing last week), so yesterday, I sent an email asking what the tracking number was, and this morning, still no email to me to advise what the tracking number is.
I just don't know what to do. I can't afford to lose the £210 that I have spent out, I can't just keep waiting and waiting for the Wii, if I start getting arsey I could lose my money anyway. Ebay only refund £120 if you have spent £500, less a £15 admin fee, so the max I would get back is £105 so I am at a complete loss as to what to do.
He will be receiving negative feedback but I want to either get my money, or my Wii before doing that.
Any suggestions??

oh no!. ive not got any great experiance with ebay, i did complain about a faulty product and had to send it back, she refunded the cost of the goods but not the postage, but it was only about £30, not as much as yours.
i hope he does turn out genuine and send you the item :kisshands:

Well, I've just been checking through his feedback and something isn't quite adding up on it...
I have just had an email off him this morning, saying that he will be sending my Wii during his lunch break today and will give me the tracking number by 2pm at the latest, so I'm hoping this means that he has taken it to work with him this morning to send off.
Having looked through his feedback, although 100% theres only 4 actual comments, which at first glance you think, well he's new etc, got to give someone a chance, just like people gave me a chance initially too, but then when you look at his previous sales...there seems to be a lot of repeats....
I'm going to be waiting with baited breath till 2pm for my tracking number.
Oh, his id is Stevie8787. I should have delved deeper into him before bidding, but then, you don't tend to do you.....but, he has always replied to my emails etc, hassling him for details, so you'd think that if he was going to take me for a ride, then he wouldn't reply......wouldn't you??

I hope you get it sorted hun. It's such a shame that people do this, as it makes others very suspicious of the genuine and professional people that do a great job. I hope you get your tracking number !
Did you get the tracking no.? If you read this tomorrow - has the Wii arrived?

Did you pay by paypal? If you did you can open a paypal dispute if you don't receive the item soon. Let me know if I can help - I have an ebay shop so can find my way around ebay quite well.

He is a very new seller - he's only done 4 transactions. He'll probably be ok hun.

Still no sign of tracking number, no reply to my email this afternoon either.
Whats worrying me now is when you look at his completed sales - he has sold a lot more than 4 items, yet has only had 4 people leave feedback for him.
How long do I let it go on for..I'm trying to give him the benefit of the doubt because he is a fairly new member, but this non receipt of goods is starting to really worry me. Roll on tomorrow and lets see what the excuse is this time...

I see that he has changed user id's this year, but you can't see why.
I think for that amount of money and poor communication I would if I have not received the goods or had a repsonse from him today open a dispute.
Email him today and tell him that if you do not hear anything regarding delivery that you will be reporting him to ebay and paypal.

oh no hun, it doesn't sound good, i have had quite a few disasters on ebay and lost almost £200 altogether. i would give him a certain amount of time to respond and tell him that you will be reporting him and opening a dispute. what a bummer hun, there are a few cowboys out there and it is a shame when there are so many genuine ebayers...x x x x x

Well, I had no email from him to let me know the supposed tracking number of my item yesterday - emailed him last night and said if I hadn't heard from him today then I would be opening a dispute with paypal etc, and still haven't heard a thing! So am going to open a dispute up and report him. I'm so angry though! Why do some people do this! Ruins it for so many other good ebayers. I'm still finding it strange how he only has 4 feedback, yet has supposedly sold about 10 items, so why has he not received feedback with regards to all of these sales.....
I just hope I can get my money back because otherwise I have lost £235 and wanted to get the Wii for the boys as a well done for all they have achieved, like with Ci and the gifted register etc.
I'm still trying to be polite with him, but its getting more and more difficult.

don't feel bad about the dispute, I don't know how much money you will get back, but you are doing the right thing. You have given him plenty of opportunities to reply.
It is really hard to spot dud sellers

I've opened a paypal dispute - I think this is the right way to start of with isn't it as I paid through paypal?
The other thing that is now confusing me - the name on the paypal receipt is completely different to the name on the sellers emails?!

He did have a previous seller id with ebay, also paypal details are often different as it is based on email address. Don't worry about that, my seller id and paypal are different too.
Have you opened a dispute with ebay too?

I've tried today, but it won't let me until the 15th March.
So far I have received no response from the seller or anything.....and the payment has now appeared on my credit card bill :(

I've seen people go to court over ebay stuff not arriving or being crap when it does and the seller not refunding etc...
You can't reverse the charges on your credit card?
I mean to say, you can't talk to your credit card company and see if they can turn those charges around? Explain what's happening etc...? Offer copies of the despute tickets to the CC company etc...?
Man I hate A-holes like that. What a jerk. :angry:

Apparently its 10 days after the end of auction, that you can file the complaint on ebay, so I tried again and because I paid via paypal, ebay redirected me to paypals complaints console, which I have already opened a file on.
Still no response from seller - not a peep - so bloody annoyed!!
Looking through the processes, it says to go through paypal first and then c card company afterwards, so will have to sit and wait now - which is even more annoying! why can't these things get sorted out quicker! Why did I be the one to buy a console off a prat of a seller who has now seemingly decided not to make any contact what so ever! ARGH!!!!

Looking at his profile today, 2 others haven't received goods from him and have now left him negative feedback and at least one of them has also filed a complaint. I've just left my neg feedback aswell. This guy appears to have played us all for fools (although I'm the one that has spent £235 with the bloody guy)

Paypal is a pretty good way to go. If he doesn't pay you back or respond or send the item then they will award it to you. The trouble is they will freeze his paypal account as soon as you open a dispute and then they will only award you what's left in paypal so if he's withdrawn the money you might not get much back. It's worth phoning the paypal helpline as they are always really helpful and great to talk to on the phone.

So even though I've opened the dispute I might not get my money back? Oh no! I think I may give them a ring then, have a chat with them about it. If the other buyer has also opened a dispute, things aren't looking great for my pounds

I can't remember how it works hun - it's not happened to me very often. You can also take him to the small claims court if that doesn't work. I'm sure you'll be able to get sorted.

If it is funded by your credit card, doesn't your credit card cover any loses?
I have had disputes with people on Ebay, luckily not for that amount of money and found Ebay most UNHELPFUL!!!

Paypal are still awaiting a response from the seller, which I would be very surprised if they ever received one.
I hope it gets sorted soon though cos being this much out of pocket isn't fun!

I've just noticed this:
A claim has been issued against this transaction. The seller's deadline for responding to this claim is 26 Mar. 2007. If the seller does not respond by the deadline, the claim will be decided in your favour. You may cancel this case at any time by clicking "Cancel" below.
Which is on the dispute thing, so the seller has another 8 days before he has to respond. Can't believe I'm going to be sat waiting till then before things are sorted out ARGH!!!!

Hi there,
I've had my share of people not sending me my winning items on EBAY, 2 years ago I won a super nintendo, paid for it through PAYPAL. I had an email from him saying he was going to send it the next day! never happend, I reported it to Ebay/Paypal and they said to give it a month which I did, but after millions of emails to this guy not answered I finally made a claim, within in a week I had a reply from him he saying he will be sending it the next day and apologized as he went on holiday and forgot about it! (which later on I found out was a lie!) and he asked me to cancel the claim, which I stupidly did! never received my item and because I closed it I never got my money back!!!!!
If the seller does send you an email like this, please don't make the same mistake I did, wait till you have received your item and it is in good working order then cancel it, if not wait till the deadline to get your money back.
If he sends you an email saying he is going to send it, DO NOT CANCEL your claim until you have received it

I had so many emails for the first week from the guy saying he was going to send it out etc and never did that I will be taking it all the way. No way am I backing down on this now. Two other people haven't received their items and when you look back through, there seems to be some inconsistencies (like he sold an x-box but no feed back received relating to it etc).

Oh well if he still hasn't botherd, the 26th is only 5 days away! He will lose out by getting very bad feedback and banned from Ebay, as he has done this a couple of times and you will have your money back! :evillaugh:

They are taking further action against the seller and if they get any further money from him, then they'll let me know, but at the mo I am £130 out of pocket - not good.

I don't think it wouldn't hurt to call CC company, update them and ask what your next step should be. That is, if you can claim on them to reverse the charges yet.
