All depends on the ISP in the first instance, their position in law is very vague as to if they carry any responsibility in law for what is carried on their service. Sometimes they can be bullied into closing a site by lawyers.
It should (IMHO) be the same as BT in that what is carried by an ISP is not their responsibility, If I said something defamatory about someone over the phone lawyers would not sue BT for carrying it, but apparently they think they can sue an ISP.
In the second instance they would have to persuade a judge to get a court order to have the site shut down, pending the outcome of the libel court case.
(this does not constitute legal advice BTW, going on what I've read.)
It's an area of law ISP's have wanted clarifying for years, but as no-one in .gov really "gets" the internet, they don't care.

There is a discussion about this on another forum that I'm a member of, but no one has mentioned her name or really discussed specifics. I've only just discovered who they were talking about!
